Terms of Service
These terms govern your use of Abhinayo at abhinayo.com (the “Service”), operated from India by Nikunj Kaushik (“we”, “us”) until a company is incorporated and named here. By creating an account you agree to them.
1. Who can use the Service
You must be 18 or older and able to enter a contract under Indian law. If you use the Service for an agency or for creators you manage, you confirm you are authorised to act for them.
2. Your account
Keep your sign-in details private and tell us at support@abhinayo.com if you think your account has been used without permission. You are responsible for what happens under your account.
3. What the Service does, and does not do
- We provide tools: ideas and scripts, an optional digital twin, posting plans, performance summaries, help with brand deals and contracts, income tracking, and ad planning.
- Suggestions are suggestions. Rates, contract notes, scripts and ad plans are generated with AI and from data other creators shared. They are not legal, tax or financial advice. You decide what to post, charge and sign.
- We do not post to Instagram or YouTube, send messages, or run ads on your behalf unless you have connected the account, approved the permission, and taken the action in the app.
- We do not hold, collect or route money between you and brands. Payments to us go through Razorpay.
4. Your content and your twin
You own what you upload and what the Service generates for you. You give us a licence to store, process and display it only to run the Service for you. You confirm you have the rights to anything you upload. Your digital twin is created only from your own voice and face samples with your explicit consent, is used only in your account, and is deleted when you ask. Videos made with a twin must be labelled as synthetic where Instagram, YouTube or the law requires it; the app defaults to labelling them.
5. Acceptable use
Do not use the Service to create a twin of anyone but yourself, to upload customer data you are not allowed to use, to send spam, to break Meta’s or Google’s rules, or to do anything unlawful. We may suspend accounts that do.
6. Connected platforms
Instagram and YouTube features depend on Meta’s and Google’s APIs, permissions and quotas, which can change or be withdrawn. By connecting YouTube you also agree to the YouTube Terms of Service.
7. Plans and payment
There is a free plan. Paid plans are billed in Indian rupees, inclusive of GST, monthly or yearly, through Razorpay, including UPI AutoPay mandates you set up. Metered features such as twin renders are charged per use at the price shown before you confirm. You can cancel any time; the plan runs to the end of the paid period, and we do not refund partial periods except where the law requires it.
8. Availability and changes
This is an early product. We may add, change or remove features, and we will give notice of changes that matter. We aim for high availability but do not guarantee it.
9. Liability
To the extent Indian law allows, the Service is provided as is, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect losses, lost deals, lost followers or platform actions taken against your accounts.
10. Ending the agreement
You can close your account at any time from Settings or by emailing support@abhinayo.com. We can close accounts that break these terms. Section 9 survives.
11. Law and disputes
Indian law applies. Courts at Bengaluru, Karnataka have exclusive jurisdiction, after a good-faith attempt to resolve the matter by email first.
